Sanctions in the veterinary sector have not been "matched" with the behavior

A number of violations in the veterinary field are of very dangerous nature, affecting human health and life, and must be strictly handled to ensure deterrence. However, the sanctions for some of these behaviors are not commensurate with the danger levels of the acts.

This comment was made by VCCI when giving comments to the Draft Decree on sanctioning administrative violations in the veterinary field on the basis of opinions of enterprises and associations.

The sanction is not reasonable

According to VCCI, some violations in the field of veterinary medicine are very dangerous, affecting human health and life, and need to be strictly handled to ensure deterrence. The draft also identifies these violations and identifies the corresponding penalty framework. However, according to VCCI, the sanctions for some of these behaviors are not commensurate with the danger levels of the acts.

Specifically, for fines such as: A fine of between VND 6,000,000 and VND 8,000,000 for acts of using veterinary drugs on the List of veterinary drugs banned from use in Vietnam to prevent animal diseases (Clause 8 Article 5); A fine of from VND 5,000,000 to VND 6,000,000 shall be imposed for "using veterinary drugs not on the List of veterinary drugs permitted for sale in Vietnam or not yet permitted by the competent authority" (Point). a, Clause 7, Article 5); A fine of from 4,000,000 VND to 6,000,000 VND for "slaughtering and trading of infected animals, showing signs of disease, dead animals, animal products carrying pathogens" (Point a, Clause 6) The 7th rule); A fine of from VND 20,000,000 to VND 25,000,000 shall be imposed for "putting water or other substances into animals before slaughtering causing unsanitary veterinary hygiene"; "Soaking, impregnating chemicals, putting water or other substances into animal products, making them unsanitary."

VCCI said: "The sanctions framework for the above acts is too light, suggest the Drafting Committee to consider and consider increasing the sanction level for the above acts".

Unknown on the subject of punishment


Also according to VCCI, Article 24 of the Draft stipulates violations of veterinary hygiene for small business markets. However, who will violate these violations? Due to the fact that there are a number of small, spontaneous, individual markets that are unknown to the management entity, responsible or managed by local authorities. "It is proposed that the Drafting Board clearly define the subject of punishment in this case to ensure the feasibility and transparency of the regulation" - The comment of VCCI stated.

Article 29 of the Draft stipulates violations of conditions for testing veterinary drugs, including violations of regulations, standards, technical processes and conditions of veterinary testing. VCCI believes that this provision does not provide for remedies while these are acts that require such measures to ensure the remedies and avoid recurrence of violations. Therefore, VCCI proposed the Board to supplement corrective measures in Article 29 of the Draft….
